What happened
Tenant applied for an order determining that Landlords failed to meet their maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The issues included mushrooms growing on the carpet and mould, a window that was covered with additional glass so it did not open, lack of or damaged window screens, the front door, and the foundation or retaining wall.
The ruling
The Landlords shall pay the Tenant a rent abatement of $487.00 for the period from July 6, 2017 to August 31, 2017 due to their failure to address the disrepair issues, other than the carpet. If the Landlords do not pay the full amount by January 15, 2018, they will owe interest at 3% annually on the outstanding balance.
