What happened

Landlord applied to terminate tenancy and evict Tenant for failing to meet conditions specified in a previous mediated settlement. The conditions included notifying the Landlord of bed bug sightings, preparing for pest control treatment, and maintaining the unit in a state of ordinary cleanliness. The Tenant breached the agreement by failing to keep the unit clean, but filed a motion to set aside the eviction order.

The ruling

The Board set aside the previous eviction order and dismissed the Landlord's application. A new conditional order was issued, requiring the Tenant to arrange for regular cleaning services, provide the Landlord with cleaning service information, allow monthly inspections, maintain cleanliness, cooperate with pest control efforts, and refrain from bringing used furniture into the unit. If the Tenant fails to comply, the Landlord may apply for termination without notice within 30 days of the breach.
