What happened

Tenant applied for an order determining that Landlords failed to meet their maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The rental unit was flooded due to a rain storm, and the Landlords failed to timely address the issue, leading to mold growth and the unit becoming uninhabitable.

The ruling

The tenancy was terminated as of September 30, 2018. The Landlords were ordered to pay the Tenant a rent abatement of $1,860.30 and $1,200.00 for expenses incurred while out of the unit due to the uninhabitable conditions, as well as the $45.00 application fee, for a total of $3,105.30 to be paid by December 18, 2018.
