What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant's representative requested dismissal based on the Real Property Limitations Act, which was denied. An adjournment request by the Tenant was also denied. The Tenant disputes the arrears, claiming cash payments without receipts.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying the outstanding amount. The Tenant must pay $30,686.00 by March 31, 2023, or $32,186.00 by April 14, 2023, to void the order. If not paid, the Tenant must vacate by April 14, 2023, and pay $29,017.64 plus $49.32 per day from February 28, 2023, until move-out.
