What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The tenancy is terminated effective July 2, 2021. The Tenants must vacate the unit by this date. The Landlord is authorized to offset the rent deposit and interest, as well as compensation for use of the unit and the application filing fee, from the amount owed to the Tenants. The Tenants can void the order by paying $4,127.17 by June 30, 2021 or $6,308.87 by July 2, 2021.
