What happened

Landlords applied to terminate the tenancy and evict the Tenant due to the Tenant's behavior seriously impairing the safety of other persons in the residential complex. The Landlords testified that the Tenant was found in possession of an old vinegar bottle containing gasoline, which posed a safety risk to other residents.

The ruling

The application is dismissed. The possession of gasoline in an unapproved container, while potentially having some safety implications, does not on its own constitute a serious impairment of the safety of other residents within the meaning of the Act.
