What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant Cassandra Vandergulik had notified the Landlord that she had moved out of the rental unit on August 24, 2022, but the other tenant Don Henderson was still in possession of the rental unit.
The ruling
The tenancy is terminated unless the Tenants pay $6,486 by March 31, 2023 or $7,461 by April 3, 2023 to void the order. If the Tenants do not void the order, they must move out by April 3, 2023 and pay the Landlord $4,995.65 plus daily compensation of $32.05 per day starting March 16, 2023.
