What happened
Tenants applied for an order determining that the Landlords gave a notice of termination in bad faith. The Landlords told the Tenants they intended to demolish the rental unit and build a new home for themselves, and sent a series of texts and an N11 agreement to terminate. The Tenants signed the N11 and vacated the unit, but later found the unit was rented out to new tenants.
The ruling
The Landlords gave a notice of termination in bad faith, the Tenants vacated as a result, and the Landlords did not demolish the unit within a reasonable time. The Tenants are entitled to $1,349.59 for moving costs, $7,800 for rent differential over one year, and $50 for the application fee, for a total of $9,199.59.
