What happened
Tenants applied to the Landlord and Tenant Board to determine whether the Residential Tenancies Act, 2006 applies to their living accommodation at the Inn, which was recently purchased by the Landlord. The Landlord argued that the Inn is subject to the Innkeepers Act and is exempt from the Residential Tenancies Act.
The ruling
The Residential Tenancies Act, 2006 applies to the units occupied by the Tenants. The Landlord failed to prove that the exemption for living accommodation intended for the travelling or vacationing public or occupied for a seasonal or temporary period applies.
