What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The tenancy began in 2017, and the Tenants persistently paid rent late from the start until early 2020. The Landlords served a notice of termination due to the persistent late payments.
The ruling
The Tenants shall pay the monthly rent on or before the first day of each month from April 2021 through March 2022. If the Tenants fail to make a payment, the Landlord may, within 30 days and without notice to the Tenants, apply under section 78 of the RTA for an order terminating the tenancy and evicting the Tenants. The Tenants shall also pay the Landlords' filing fee of $175.00 by April 10, 2021, with simple interest of 2.00% annually on any outstanding balance.
