What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant obtained summary legal advice from Tenant Duty Counsel prior to the hearing.

The ruling

The tenancy is terminated effective January 4, 2021. The Tenant must pay the Landlord $11,857.48, which represents the rent arrears and compensation up to December 4, 2020, less the rent deposit and interest owed on the deposit. The Tenant must also pay $42.74 per day for compensation for use of the unit starting December 5, 2020 until the Tenant moves out. If the Tenant does not pay the full amount by December 15, 2020, the Tenant will owe interest. If the unit is not vacated by January 4, 2021, the Landlord may file the order with the Sheriff for enforcement. The Tenant can void the order and continue the tenancy by paying $14,475 by December 31, 2020 or $15,775 by January 4, 2021.
