What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation for their child. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.

The ruling

The Landlord's application is dismissed. The Tenant shall not cash the cheque given to her on July 12, 2021 in the amount of $1301.36. The Tenant's Representative shall forward the original cheque given to the Tenant for one month's compensation and an additional $250.00 to the Landlord's Representative no later than November 17, 2021.
