What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and substantial interference. The Landlord served a valid N4 notice, but the Tenant did not void the notice by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.

The ruling

The tenancy is terminated unless the Tenant pays the full arrears of $23,436 by December 31, 2022 or $24,986 by January 31, 2023 to void the order. If the Tenant does not pay, they must vacate the unit by January 31, 2023 and pay the Landlord $20,571.03 in arrears and filing fees.
