What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Landlord claimed the Tenants did not void by paying the arrears. However, the Landlord was unable to establish that the Tenants were in arrears when the application was filed.
The ruling
The Landlord's application was dismissed as the Tenants were not in arrears when the application was filed. The Landlord was ordered to pay $375 in costs to the Tenants due to the Landlord's unreasonable conduct in pursuing the application without sufficient evidence.
