What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to substantial interference with the reasonable enjoyment and/or lawful right, privilege or interest of the Landlord or another tenant. The Landlord served two N5 notices for multiple disturbances, fighting, loud noises, smoking in common areas, and leaving unattended broken glass and syringes in the hallway.

The ruling

The tenancy is terminated, and the Tenants must vacate the rental unit by February 21, 2022. The Tenants must pay the Landlord $6,510.54, which represents compensation for the use of the unit from August 28, 2021 to February 10, 2022, less the rent deposit and interest owed on the deposit. The Tenants must also pay $47.67 per day for compensation for the use of the unit from February 11, 2022 until they move out, as well as $186.00 for the cost of filing the application.
