What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant had accrued arrears due to a misunderstanding of their legal rights, but had made a substantial payment to the Landlord and filed their own application with the Board.
The ruling
The Landlord's application for eviction of the Tenant is denied on the condition that the Tenant pays the outstanding $361.20 in three equal installments by April 14, 2021, and continues to pay the lawful monthly rent on time. If the Tenant fails to make any of the payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and the balance owing shall become payable with interest.
