What happened

Landlord applied for an order requiring Tenant to pay the rent that the Tenant owes, and an order to terminate the tenancy and evict the Tenant because the Tenant entered into an agreement to terminate the tenancy.

The ruling

The Landlord's application to terminate the tenancy is dismissed. The tenancy is terminated on July 6, 2020, the date the Tenant vacated the rental unit. The Tenant shall pay the Landlord $7,543.09, which represents the rent owing up to July 6, 2020, less the payment of $1,040.00, the last month's rent deposit, and interest owing on the last month's rent deposit. The Tenant shall also pay the Landlord $190.00 for the cost of filing the application. If the Tenant does not pay the full amount owing by August 17, 2021, the Tenant will start to owe interest at 2.00% annually on the outstanding balance.
