What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenant did not void the notices by paying the arrears. The Tenant had vacated the rental unit prior to the hearing date.
The ruling
The tenancy is terminated effective November 28, 2021, unless the Tenant pays $305 to void the eviction order. The Landlord is authorized to offset compensation for the Tenant's continued occupation and the application filing fee from the rent deposit and interest owed to the Tenant.
