What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were in possession of the rental unit on the application date.
The ruling
The tenancy is terminated effective December 4, 2021. The Tenants must pay the Landlords $6,110.79, which represents the rent arrears up to November 23, 2021 and the cost of filing the application. The Tenants must also pay $34.64 per day for compensation for the use of the unit starting November 24, 2021 until they move out. If the Tenants do not pay the full amount owing by December 4, 2021, they will start to owe interest. If the unit is not vacated by December 4, 2021, the Landlords may file the order with the Court Enforcement Office for enforcement. The Tenants can void the order and continue the tenancy by paying $6,506.94 on or before November 30, 2021 or $7,560.43 on or before December 4, 2021.
