What happened

Landlord applied to determine whether the Residential Tenancies Act, 2006 applies to the tenancy. The Landlord and Tenant's representative are brothers, and the Landlord had previously granted the Tenant's representative and his spouse the exclusive right to permit occupancy of the rental unit. The Landlord has now terminated that arrangement.

The ruling

The Landlord is the sole Landlord of the property, effective February 7, 2023, as the arrangement with the Tenant's representative has been terminated.
