What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent as per the previous LTB order. The Tenant failed to pay the lawful rent on or before June 1, 2023 and the $5,000 towards rent arrears by May 31, 2023 as required by the previous order.

The ruling

The tenancy is terminated effective July 9, 2023. The Tenant must pay the Landlord $20,585.28 (less any payments made after June 8, 2023) for rent arrears and the cost of the previous application. The Tenant must also pay the Landlord $77.26 per day for compensation for use of the unit starting June 29, 2023 until the Tenant moves out. If the Tenant does not pay the full amount by July 9, 2023, the Tenant will owe interest at 6% annually on the outstanding balance.
