What happened

The Tenant applied to the Landlord and Tenant Board to determine whether the Residential Tenancies Act, 2006 applies to the tenancy. The Landlord asserted that the tenancy is commercial in nature and falls within the exemption listed in subsection 5(j) of the Act.
