What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The N8 notice was found to be invalid.
The ruling
The tenancy is terminated unless the Tenant pays $26,628 by May 18, 2024 to void the order and continue the tenancy. If the Tenant does not pay, they must vacate the unit by May 18, 2024 and pay the Landlord $23,127.12 plus daily compensation of $39.45 from April 5, 2024 until move-out. The L2 application is dismissed.
