What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. The Tenants did not attend the hearing. The Landlord served a Notice of Termination effective June 21, 2017, due to rent arrears for the period from June 1, 2017 to July 31, 2017.

The ruling

The tenancy is terminated effective July 25, 2017, unless Tenants void the order by paying $1,355.02 to the Landlord or Board in trust by that date. The Landlord owes the Tenants $926.04 after offsetting rent arrears against the rent deposit and interest. The Landlord is authorized to offset $44.55 per day for compensation starting July 15, 2017, until Tenants move out, plus $175.00 for application filing costs.
