What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent as per the terms of a previous mediated settlement. The Tenant failed to pay May 2020 rent and $600 towards arrears as required by the settlement.

The ruling

The tenancy is terminated effective August 16, 2020. The Tenant must pay the Landlord $23,956.22, which includes rent arrears up to May 31, 2020 and costs from the previous application, less the rent deposit and interest owed on the deposit. The Tenant must also pay $88.77 per day in compensation for use of the unit starting June 1, 2020 until the Tenant vacates. If the full amount is not paid by August 16, 2020, the Tenant will owe interest at 2% annually on the outstanding balance.
