What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The N8 notice was found to be defective, but the N4 notice for non-payment was valid. The Tenant had not paid rent from December 1, 2019 to April 30, 2021.
The ruling
The tenancy is terminated effective May 17, 2021. The Tenant must pay the Landlord $8,895.89, plus $24.66 per day starting May 7, 2021 until the Tenant vacates the unit. If the Tenant pays $11,170 on or before May 17, 2021, the eviction order will be void and the tenancy will continue.
