What happened

Tenants applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served an N12 Notice claiming the property was sold and the purchaser intended to move in. However, the Landlord subsequently advertised the unit for rent at a higher price.

The ruling

The Landlord's N12 Notice was found to be in bad faith. The Tenants were awarded $3,852.25 for rent abatement, increased rent incurred, moving expenses, and application fee. The Landlord was also ordered to pay a $2,000 administrative fine to the LTB.
