What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The Tenants shall pay the Landlord $8,775.00 as follows: $700.00 on or before the 15th day of each month for twelve months starting December 15, 2020 to November 15, 2021; and $375.00 (remaining arrears) on or before December 15, 2021. The Tenants shall also pay the Landlord rent owing for the months of December 2020 to December 2021 inclusively, no later than the first business day of each month. If the Tenants fail to make any one of the payments in accordance with this order, the outstanding balance of any arrears of rent and costs to be paid by the Tenants to the Landlord pursuant to paragraph 1 of this order shall become immediately due and owing and the Landlord may, without notice to the Tenants apply to the Board pursuant to section 78 of the Act for an order terminating the tenancy and evicting the Tenants and requiring that the Tenants pay any new arrears, NSF fees and related charges that became owing after November 30, 2020.
