What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant had already vacated the rental unit on November 2, 2022, prior to the hearing date. The Landlord sought rent arrears up to December 26, 2022, but the Board determined that rent arrears should only be calculated up to the date the Tenant vacated.

The ruling

The tenancy was terminated effective November 2, 2022, the date the Tenant vacated the rental unit. The Tenant is ordered to pay $9,385.96 to the Landlord, which includes rent arrears up to the move-out date and the cost of filing the application, minus the rent deposit and interest on the deposit.
