What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date.

The ruling

The tenancy is terminated effective May 31, 2023. The Tenants must vacate the rental unit by this date. If they do not, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction. The Tenants owe the Landlord $6,154.52 for use and occupation from May 1, 2022 to October 3, 2022, and an additional $39.45 per day from October 4, 2022 until the move-out date. If the full amount is not paid by May 31, 2023, the Tenants will owe interest at 5% annually on the outstanding balance.
