What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent as per a previous mediated settlement. The Tenant did not pay the $5,914.42 as required by the settlement.

The ruling

The tenancy is terminated effective August 29, 2020. The Tenant must pay the Landlord $4,666.31, which includes rent arrears up to August 18, 2020 and costs from the previous application, less the rent deposit and interest owed on the deposit. The Tenant must also pay $40.29 per day for compensation for use of the unit starting August 19, 2020 until the Tenant moves out. If the full amount is not paid by August 29, 2020, the Tenant will owe interest at 2% annually on the outstanding balance.
