What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The N4 Notice of Termination contained confusing information about the rent charge, which was different from the NORI and the amount the Tenant believed was the lawful rent. The Landlord also failed to provide proof that the Tenant's payments were intended to be applied to back rent.

The ruling

The application was dismissed. The Landlord's request for an eviction order under the L1 application was denied due to the inaccuracies and ambiguities in the N4 Notice of Termination.
