What happened
Tenants applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served the Tenants with an N12 notice to terminate the tenancy so the Landlord could move into the rental unit, but the Tenants alleged the Landlord did not actually move in and instead rented the unit to students.
The ruling
The Landlord shall pay the Tenants $2,898.78 for reasonable out-of-pocket expenses and $50 for the cost of filing the application, for a total of $2,948.78. If the Landlord does not pay the full amount by November 24, 2021, the Tenants will be owed simple interest at 2% annually on the outstanding balance.
