What happened

Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the Tenant did not void by paying the arrears. The Tenant had transferred possession of the rental unit to his sister as of February 1, 2021, and she has been paying rent to the Landlords from that point onwards.

The ruling

The tenancy between the Landlords and the Tenant terminated effective January 31, 2021. The Tenant is ordered to pay the Landlords $705.31, which includes rent arrears and compensation up to January 31, 2021, less the rent deposit and interest owed on the deposit. The Tenant is also ordered to pay the Landlords $186 for the cost of filing the application.
