What happened

Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a flawed N4 Notice, which did not include the full amount of rent arrears. The Landlords obtained vacant possession of the rental unit on October 29, 2020, prior to the hearing.

The ruling

The Tenant shall pay the Landlords $4,338.31, which represents the rent arrears and compensation up to October 29, 2020, less the rent deposit and interest owed on the deposit. The Tenant shall also pay $186.00 for the application filing fee, for a total of $4,524.31. If the Tenant does not pay the full amount by November 17, 2020, they will owe simple interest at 2% annually on the outstanding balance.
