What happened

Landlords applied to terminate the tenancy and evict the Tenant due to persistent late payment of rent and undue damage to the rental unit. The Tenant has not paid rent in the last five months and has caused damage to the property, including damage to the walls, refrigerator, and smoking in the garage.

The ruling

The tenancy is terminated effective February 1, 2022. The Tenant must move out by that date and pay the Landlords $1,500 for the damage, $4,570.92 for the use of the unit from November 2, 2021 to January 21, 2022, and $90.41 per day for the use of the unit from January 22, 2022 until the Tenant moves out. The Tenant must also pay the $186 application fee. If the Tenant does not pay the full amount by February 1, 2022, the Tenant will owe interest at 2% annually on the outstanding balance.
