What happened
Landlord applied for an order to terminate the tenancy of Tenant and for compensation for the use of the rental unit because the Tenant transferred possession of the unit to an Unauthorized Occupant in a manner not permitted under the Residential Tenancies Act.
The ruling
The tenancy between the Landlord and Tenant is terminated as of February 18, 2022. The Unauthorized Occupant shall move out of the rental unit on or before February 18, 2022. If the unit is not vacated by February 18, 2022, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction. The Unauthorized Occupant shall pay the Landlord $15,616.10 for compensation for the use of the unit from August 1, 2021 to February 7, 2022, and an additional $201.00 for the cost of filing the application. If the Unauthorized Occupant does not pay the full amount by February 18, 2022, they will owe interest at 2.00% on the outstanding balance.
