What happened
Tenants applied for an order determining that the Landlord harassed, obstructed, coerced, threatened or interfered with them and substantially interfered with their reasonable enjoyment of the rental unit or residential complex by unilaterally removing their free parking spot and charging $80.00 per month.
The ruling
The Landlord is prohibited from charging the Tenants for a parking spot in the future. The Landlord shall reimburse the Tenants $1,280.00 for the parking fees paid from August 2019 through November 2020, and shall also pay the Tenants $45.00 for the cost of filing the application. If the Landlord does not pay the full amount by December 31, 2020, the Tenants may deduct $320.00 per month from the rent until the overcharges are fully recouped.
