What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to undue damage to the premises, substantial interference with the reasonable enjoyment or lawful right of other Tenants, committing an illegal act, and seriously impairing the safety of other persons. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.
The ruling
The Landlord's application for eviction of the Tenant is denied. The Tenant shall pay the Landlord $992.71 for the balance owing for the damages incurred due to the kitchen fire, and $201.00 for the cost of filing the application. If the Tenant does not pay the full amount owing by July 31, 2021, the Tenant will start to owe simple interest calculated from August 1, 2021 at 2.00% annually on the balance outstanding.
