What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy was terminated effective February 1, 2022. The tenants were ordered to pay $650.26 to the landlord, which includes rent arrears up to the termination date and the cost of filing the application, minus the rent deposit. The tenants were also ordered to pay $42.74 per day for compensation for use of the unit starting January 8, 2022 until the date they vacate. The tenants had the option to void the order and continue the tenancy by paying $3,105 if paid by January 31, 2022 or $4,405 if paid by February 1, 2022.
