What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant lives in supportive housing provided by the Landlord and is a vulnerable Tenant who would struggle to find alternative housing. The Tenant fell behind on rent due to issues with the rental unit, but has since reinstated payments and been paying rent in full and on time.

The ruling

The Landlord's application for eviction is denied on the condition that the Tenant pay $150 per month towards the $2,660 in arrears, with a final payment of $1,010 due on February 1, 2022. The Tenant must also pay the rent for January and February 2021 by February 15, 2021, and the rent for March 2021 to February 2022 on the first of each month. If the Tenant fails to make any of the required payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
