What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the tenants did not void by paying the arrears. The tenants had not vacated the rental unit by the hearing date.
The ruling
The tenancy is terminated effective February 15, 2021. The Tenants shall pay the Landlord $1,585.68, which includes rent arrears up to February 4, 2021 and the Landlord's filing fee, less the rent deposit and interest on the deposit. The Tenants shall also pay the Landlord $9.04 per day in compensation for the use of the unit from February 5, 2021 to the date they vacate. If the Tenants do not pay the full amount by February 15, 2021, they will owe simple interest at 2% annually on the outstanding balance.
