What happened
Landlord applied for an order to terminate the tenancy and evict Tenant because the Tenant did not meet a condition specified in the order issued by the LTB on December 20, 2022. The Tenant and/or Tenant's guests failed to refrain from committing acts that substantially interfere with the reasonable enjoyment of other residents by smoking a substance in an indoor common area on January 12, 2023.
The ruling
The tenancy is terminated effective April 07, 2023. The Tenant must vacate the rental unit by this date. If the unit is not vacated, the Landlord may file the order with the Court Enforcement Office (Sheriff) for eviction enforcement starting April 08, 2023. The Tenant has until April 06, 2023 to file a motion with the LTB to set aside the order under s. 78(9) of the Act.
