What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were in possession of the rental unit on the application date.

The ruling

The tenancy is terminated effective November 13, 2020. The Tenants must pay the Landlord $3,921.55, which includes rent arrears up to November 2, 2020 and the application filing fee, plus $12.33 per day for each day of occupation starting November 3, 2020 until they vacate the unit. If the Tenants pay $4,255.33 on or before November 13, 2020, the eviction order will be void and the tenancy will continue.
