What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The Tenant paid the rent arrears and additional rent due before the hearing, so the application for non-payment was discontinued. The Landlord's application for persistent late payment was heard, and the Landlord's evidence showed the Tenant had persistently paid rent late since the start of the tenancy.
The ruling
The Landlord's application for persistent late payment was granted. The Tenant must pay the full lawful rent on or before the first day of each month, commencing March 1, 2023 and for 12 months thereafter. If the Tenant fails to comply, the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
