What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective August 18, 2020. The Tenants must move out of the rental unit on or before August 18, 2020. The Tenants shall pay the Landlords $8,880.00 (less any amount paid by the Tenants to the Landlord after the hearing) for rent arrears and compensation up to March 31, 2020, plus $65.69 per day for compensation for the use of the unit starting April 1, 2020 to the date the Tenants move out of the unit, less the rent deposit ($2,000.00) and interest the Landlords owe on the rent deposit ($7.20). The Tenants shall also pay the Landlords $190.00 for the cost of filing the application. If the Tenants do not pay the full amount owing on or before August 18, 2020, they will start to owe interest at 2.00% annually on the balance outstanding.
