What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Tenant has been late in paying rent 10 times in the past year, though the Tenant occasionally pays in lump sums after the Sheriff has arrived to enforce a previous eviction order.

The ruling

The Tenant shall pay the rent on or before the first day of each month commencing on April 1, 2021 up to and including March 1, 2022. If the Tenant fails to make any of the payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant. The Tenant shall also pay the Landlord $175 for the cost of filing the application. If the Tenant does not pay the full amount owing by April 9, 2021, the Tenant will start to owe interest at 2% annually on the outstanding balance.
