What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because they did not meet a condition specified in a previous LTB order. The condition breached was related to interference with other residents or the Landlord's reasonable enjoyment, specifically by screaming or yelling unnecessarily on December 28, 2022 and January 2, 2023, including yelling from the balcony of the unit.

The ruling

The tenancy is terminated effective April 07, 2023. The Tenants must vacate the rental unit by this date. If they do not, the Landlord may file the order with the Court Enforcement Office (Sheriff) for eviction enforcement starting April 08, 2023. The Tenants have until April 06, 2023 to file a motion with the LTB to set aside the order under s. 78(9) of the Act.
