What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. Tenant applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards.
The ruling
The Landlord's application was dismissed. The Landlord was ordered to complete the necessary repairs and replacements in the Tenant's unit, including replacing windows and repairing damaged walls, window frames, ceiling and floors. The Tenant was awarded $50 for the cost of filing the application.
