What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Landlord issued 8 Notices of Termination for Non-Payment of Rent from November 2015 to November 2016, and the rent was paid late 12 out of 12 months in a row. The Landlord also submitted evidence of 9 previous LTB applications since the tenancy began in 2008.
The ruling
The tenancy is terminated effective February 28, 2017. The Tenant must vacate the rental unit by this date. The Landlord owes the Tenant $1,282.70 after accounting for the rent deposit and interest. The Landlord is authorized to offset daily compensation of $42.34 from February 1, 2017, until the Tenant moves out, as well as the $170.00 application filing fee. If the unit is not vacated by February 28, 2017, the Landlord may file for eviction enforcement starting March 1, 2017.
